These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and PT Beaute Haul Indonesia ("Company", “we”, “us”, or “our”). BeautyHaul is an e-commerce that sells beauty products from within the country as well as intermediary services for purchasing & drop shipping goods from stores in the USA, UK, Korea, & others.[B1]  This Terms and Conditions is made concerning your access to and use of the [insert website link] website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

INTELLECTUAL PROPERTY RIGHTS

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

USER REPRESENTATIONS

By using the Site, you represent that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms and Conditions; (4) you are not a minor in the jurisdiction in which you reside; (5) every time you places an order has agreed to order it without coercion from any party; (6) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (7) you will not use the Site for any illegal or unauthorized purpose; and (8) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

COMPANY REPRESENTATIONS

By using the Site, we represent that: (1) We are not responsible for manufacturing defects from the factory; (2) The products sold at our Site are ready stock, 100% authentic and 100% certified by the

Drug and Food Supervisory Body (Badan Pengawas Obat dan Makanan or “BPOM”); (3) We are not responsible in the form of complaints about the use of the products used, such as irritation, skin problems, and others as a result of the products that have been purchased by you; (4) All packaging processes carried out by the Company’s warehouse always use CCTV.

PRIVACY POLICY

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy posted on the Site.

MAKING PURCHASES THROUGH WEBSITE

You may only make purchases through a Website if you are over the age of legal majority in your jurisdiction of residence. Purchases will only be shipped to a valid mailing address (as determined by the Company in its sole and absolute discretion). However, please note that we may not be able to ship to all valid addresses and, in such circumstances, we reserve the right in our sole and absolute discretion to cancel your purchase transaction (“Order”). In the event we are not able to ship to the shipping address you provide, we will notify you, your Order will be cancelled, and you will receive a refund in respect of your Order (unless you are able to provide an alternate eligible shipping address).

All Orders made through a Website are subject to the terms and conditions of this Agreement, as well as any other applicable terms and conditions outlined on the Website relating to the Order. Pricing and other terms and conditions relating to the purchase, refund, or delivery of your Order may be changed at any time without notice. Prices may differ from those for purchases made through other channels. You have a legal obligation to pay for any Orders indicated to be made by you. By completing an Order through a Site, you are agreeing to pay, in full, the prices and all applicable taxes and specified shipping and handling and other fees in relation to your Order, either by credit card or other permitted payment method. Payments are processed by a third party service provider and the Company does not collect your financial information. The Company will only charge you the invoiced amount, but your financial institution may charge you a service charge or other bank fees.

The Company reserves the right, in its sole and absolute discretion, to change the permitted methods of payment, including without limitation, the credit cards and/or other types of payment options we are able to accept, at any time. If complete payment for your Order is not received and verified by us, your Order will not be processed. If you do not complete or improperly complete your Order it may not be accepted or acknowledged.

In order to complete an Order through a Site, you may be required to provide certain additional information that is required to process your Order. For example, you will be required to provide valid payment information (e.g. a valid credit card number and expiration date) to facilitate payment of your Order.

Please note that merchandise is only held for you once you have completed your Order. Adding an item or items to your shopping cart (“Cart”) does not reserve such item(s) for you or guarantee that you will be able to purchase such item(s) at a later date. An item can sell out while it's sitting in your Cart. If an item was removed from your Cart, this may mean that we have sold out prior to you completing your Order. The Company reserves the right, in its sole and absolute discretion, to change the prices offered at anytime, including without limitation, items that have been placed in your Cart.

You will be billed for your Order at the time your Order is placed. You will be responsible for all applicable taxes related to your Order. Applicable taxes will be charged at the time you are billed. Applicable sales tax will also be applied to the shipping and handling, return shipping and gift packaging or other charges. Taxes may depend on delivery location.

CANCELLATION BY CUSTOMER

If you cancel an order 5 times in a month, our system will automatically “ban” your account. The ban is permanent and all loyalty points in our Site will be forfeited.

REFUND

The Company do not accept refunds or goods for any reason other than our negligence. The negligence in question is:

• Items sent did not match what was ordered (wrong delivery)
• Out of stock
• Items sent are less or not delivered
• Item not wrapped with bubble wrap
• and other errors originating from HINT

In the event that your purchase items that have been paid fully but are out of stock, our admin will inform and also assist in the refund process within 1x24 hours.

DELIVERY

The estimated delivery time will be specified in your Order; however, as we use a third party to deliver Orders, it is possible that your Order will arrive before or after the estimated delivery time. We will use commercially reasonable efforts to deliver your Order as quickly as possible within the time period(s) indicated; however, we will not be responsible for any delays in delivery that are beyond our control. If you do not receive your Order within 7 days of the estimated delivery time, please let us know via Contact Us section. Please note that multiple Orders may not always be shipped together. In addition, depending on the size of your Order you may receive several shipments to complete your Order.

WARRANTY

We will perform its obligations under these Terms and Conditions to the best of its ability and due care.

Customer Satisfaction is our priority. You can contact us at any time through the contact address listed below in this Terms and Conditions. We will endeavor to resolve your concerns and will contact you as soon as possible. Complaints about product warranties will take longer to resolve as the resolution may involve the role of the manufacturer or supplier.

In submitting a complaint, it will be very helpful if you can explain your complaint clearly and accurately, and if possible please also provide us with a copy of the Order or at least your Order Number as stated in the Order Confirmation. In rare cases, your email may enter our spam filter or we may not receive it, or the correspondence we send to you may not otherwise be received by you. If you do not receive a response from us within five (5) Business Days, please contact us again.

FORCE MAJEUR

We are not liable to you for any breach, obstruction or delay in execution of the Contract caused by any circumstances beyond our control, including but not limited to:

• Strikes, lock-outs or other industrial actions
• Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
• Fire, explosion, storm, flood, earthquake, landslide, plague or other natural disaster.
• Limitations or inability to use trains, sending planes, motorized transportation or other means of transportation, whether public or private.
• Limited or unusable public or private telecommunications networks
• Actions, decrees, laws, regulations or restrictions of any government, shipping, postal or other transport-related strikes, failure or accident.
